Lotus Flowers – Refund and Return Policy

1. Finality of Sales:
Please be advised that all sales conducted through the Lotus Flowers online store are considered final. Once an order has been placed and payment processed, it cannot be canceled or refunded except as explicitly stated herein.
2. Perishable Nature of Goods and Limitation on Refunds:
Due to the inherent perishable nature of floral products, Lotus Flowers does not offer refunds for any purchased items.
3. Replacements Under Specific Conditions:
While refunds are not provided, Lotus Flowers may, at its sole discretion, offer a replacement of the originally ordered product under the following strictly defined circumstances:
a. Quality Issues: A replacement may be considered if the delivered floral product exhibits demonstrable and significant quality defects upon arrival. This includes, but is not limited to, instances of substantial damage during transit or the clear absence of freshness in the flowers.
b. Discrepancies in Order Fulfillment: A replacement may be considered in cases where there is a verifiable discrepancy between the items ordered and the items received (e.g., incorrect floral type, significant deviation from the agreed-upon arrangement, or missing components explicitly listed in the product description).
4. Exclusions for Replacements:
Lotus Flowers explicitly reserves the right to refuse requests for replacement under the following circumstances:
a. Dissatisfaction with Aesthetic Preferences: Replacements will not be issued based on subjective dissatisfaction with the aesthetic qualities of the floral arrangement, including but not limited to color variations within a natural range, style preferences, or perceived size differences that are within reasonable tolerances of the product description.
b. Failure to Provide Adequate Evidence: The customer bears the sole responsibility of providing clear and irrefutable photographic or other documentary evidence of the alleged quality defect or order fulfillment error within 24 hours of the documented delivery time. Failure to provide such evidence may result in the denial of a replacement request.
c. Improper Care After Delivery: Lotus Flowers is not liable for any deterioration or damage to the floral product resulting from improper handling, storage, or lack of appropriate care by the customer after the delivery has been successfully completed.
5. Procedure for Replacement Requests:
To initiate a replacement request, the customer must adhere to the following procedure:
a. Notify Lotus Flowers via email at Lotusflowers4@hotmail.comor by telephone at +1 (305) 322-4416 within 24 hours of the documented delivery time.
b. Provide a detailed description of the issue encountered, accompanied by clear and comprehensive photographic or other documentary evidence substantiating the claim.
c. Retain the original floral product in its delivered condition until instructed otherwise by Lotus Flowers staff.
6. Decision on Replacement:
Upon receipt of a valid replacement request and supporting evidence, Lotus Flowers will conduct a thorough review of the claim. The decision to provide a replacement rests solely with Lotus Flowers. If a replacement is approved, Lotus Flowers will arrange for the delivery of a comparable floral product within a reasonable timeframe, subject to availability.
7. Limitation of Liability:
The provision of a replacement as outlined in this policy constitutes the sole and exclusive remedy available to the customer for any issues related to the quality or fulfillment of their order. To the fullest extent permitted by applicable law, Lotus Flowers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to the purchased floral products.
By placing an order with Lotus Flowers, the customer acknowledges and agrees to be bound by the terms and conditions of this Refund and Return Policy.
